Welcome to 5 Star Lift. These Terms of Service ("Terms") govern your access to and use of the 5 Star Lift website and software (the "Service"). 5 Star Lift is operated from the State of Tennessee, United States. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
5 Star Lift is a review generation and reputation management tool that helps service businesses automate Google review requests to their customers. The Service integrates with your Google Business Profile and sends SMS and email messages on your behalf.
You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You are solely responsible for ensuring that you have obtained the proper consent from your customers to receive SMS and email communications, in compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any other applicable laws, including Tennessee state law. You agree to indemnify 5 Star Lift against any claims arising from your violation of these laws.
All content, features, and functionality of the Service—including the 5 Star Lift name, logo, and software—are owned by 5 Star Lift and protected by copyright and trademark laws. You may not use our branding without prior written permission.
The Service integrates with third-party platforms such as Google Business Profile and (in the future) Jobber and Housecall Pro. Your use of those platforms is governed by their own terms. We are not responsible for the availability or performance of third-party services.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will result in a specific number of reviews, higher Google rankings, or increased revenue.
To the maximum extent permitted by law, 5 Star Lift shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits or lost data, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.
We reserve the right to suspend or terminate your account at any time for violation of these Terms, with or without notice.
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Tennessee, and you consent to the personal jurisdiction of such courts.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered in Tennessee, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial and to participate in any class action lawsuit. Nothing in this section prevents either party from seeking injunctive relief in court to protect its intellectual property or confidential information.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.
